CONTRACT TERMS AND CONDITIONS:
This is a binding Agreement is urged to read and review this agreement before signing, and if any questions regarding the terms and conditions herein, to consult with legal counsel.
CUSTOMER INFORMATION ACCURACY. Customer is liable for the accuracy of any information regarding customer address or storage site locations. Customer shall be liable for any additional charges incurred by UPS,LLC.(Unique Portable Storage,LLC.)for additional travel and or storage expenses as a result of inaccurate information supplied by customer.
CUSTOMER WARRANTY. Customer warrants that any and all Customer owned vehicles, RV's,Trailers, Equipment, Boats, to be stored on UPS Storage Lot, or transported by UPS to Customer or third party sites, is in good working order, and is capable of being transported safely by UPS. Customer bears full responsibility and liability for any and Customer owned items, which is unsafe, or not in good working order, which causes any property damages or injuries to any UPS employees, agents, or equipment, or that of third parties.
UNIQUE PORTABLE STORAGE,LLC. ('UPS") is a Georgia LLC. authorized to conduct business within the State of Georgia. Customer by signing below, hereby expressly states that they are authorized , and have the legal capacity to enter into this agreement, and that they are authorized to conduct business in Georgia.
EFFECTIVE DATE: This agreement shall become effective on the date of execution by both parties hereto.
RENT DUE DATE: Rents (first 30 day rental fee), delivery and pickup fee, moving supplies,and deposits,will be due and payable upon the initial signing of this contract. Payment for 2nd months and those after, shall be due on the 1st day of the 2nd 30 day rental period. If container was rented on the 15th of June, you must send next payment on or before July 15th, a $1.50 per day late fee will be assessed if not received on due date and will be considered as additional rent .Customer assumes full responsibility for lost or damaged mailed rent payments.This agreement shall continue on a month to month basis thereafter and shall remain in force until terminated by either party by written notice to the other.
CUSTOMER WEEKLY INSPECTION NOTICE: Customer, by signing this agreement, acknowledges that UPS, through an employee, owner, agent, has informed Customer of the importance of weekly inspections of storage container , and that an inspection of the storage unit was conducted prior to execution of this Agreement for any and all water leakage, and that no evidence of water leakage was detected. Customer bears all responsibility for any all damage or loss caused by water leakage that could have been detected by regular inspections.
WAIVER OF LIABILITY: Customer assumes full risk of loss and bears all liability for all damages resulting from the damage or loss of stored personal property items and/or Customer owned storage container, car, equipment, boat, RV,Trailer, etc, whether stored on UPS property, or transported to or from, or stored on Customers or third party property. Customer assumes all risk and liability arising from the use and operation of the UPS container, Customer assumes full responsibility for loss, damage, or destruction of the UPS container used by the Customer.
PACKING,LOADING, AND UNLOADING: Customer is responsible for all packing of goods for transit, including loading and unloading. It is the sole responsibility of Customer to pack all personal effects using proper containers and protective padding supplied by the Customer. Customer will supply on lock to secure container.
HAZARDOUS MATERIALS: Customer agrees not to store, pack any hazardous material of any type ( including but not limited to petroleum products, compressed gases, corrosives,explosives,and flammables) in the container.
INDEMNIFICATION: Customer agrees to defend, hold harmless and indemnify UPS for any legal action and/or claims, including attorney's fee's and court cost incurred by UPS in any such resulting legal action, arising from any acts, omissions or negligence by customer during any rental period under this agreement, including but not limited to operation of motor vehicles, delivery or removal of personal property, or for transportation thereof, and including the improper handling or storage of any dangerous, flammable, or explosive materials.
ATTORNEY FEES: The prevailing party to any legal action taken to enforce the terms of this agreement shall be entitled to an award of reasonable attorney fees as awarded by the Court, including any cost, attorney fees or collection agency fees incurred in attempting to collect any amounts so awarded by the Court.
RIGHT OF ENTRY AND DISPOSAL: Property contained in a UPS container, shall be subject to a lien if rental money payments are delinquent. Without limiting the right of UPS to conclude that excessive non-payments by the customer failure to communicate any alternative payment method shall deemed as abandonment by customer. After 10 days of no payment a finance charge of 11/2 % per day of the past due balance will be charged. After 30 days of non-payment, the account will be suspended and all applicable charges will be added to the account.If after 60 days, the Customer has not made alternate payment arrangements and no form of payment have been received by UPS's, UPS will assume ownership of contents in the UPS containers. and contents will be sold at public sale for fair and reasonable amount.
Customer will agree to give excess to property where UPS container is stored, and hold UPS harmless for picking up UPS container for delinquent non payment of rental payments that are past due. At this time UPS has taken ownership of contents for non payment and will exercise its rights according to this agreement and load the UPS container on the truck and take possession of container.
